1. PARTIES

This Distance Sales Agreement (“Agreement”) is entered into by and between PT BOHEM BALI LIVING, located at

F7Q9+99C, Jl. Sukma Kesuma, Peliatan, Kecamatan Ubud, Kabupaten Gianyar,
Bali 80571, Indonesia

(“Seller”), and the individual or legal entity purchasing services via www.bohembalitravel.com (“Buyer”).

The Seller and the Buyer shall be referred to individually as a “Party” and collectively as the “Parties”.


2. DEFINITIONS

  • Cookie Policy: The policy describing the use of cookies to ensure website functionality and improve user experience.
  • Privacy & Personal Data Protection Policy: The policy explaining how the Buyer’s personal data is processed by the Seller.
  • Service: Tours, transfers, hotel reservations, transportation and other travel-related services offered through the Website.
  • Buyer: The individual or entity purchasing Services through the Website.
  • Personal Data: Any information that directly or indirectly identifies a natural person.
  • KVKK: Turkish Personal Data Protection Law No. 6698 (where applicable to Turkish residents).

3. SCOPE & SUBJECT OF THE AGREEMENT

This Agreement sets out the rights and obligations of the Parties with respect to reservations and purchases made electronically via www.bohembalitravel.com.

For consumers residing in Turkey, this Agreement is prepared in accordance with the Consumer Protection Law No. 6502 and the Distance Sales Regulation. For other jurisdictions, the relevant local laws and regulations may additionally apply.


4. SERVICES & DELIVERY

The Buyer declares that they have read, understood and accepted the content, scope, pricing and conditions of the Services purchased via the Website. All such details are made available on the relevant product pages.

Service Delivery

  • The purchased Service will be provided on the dates and times specified on the Website and/or in the confirmation email.
  • If the Buyer requests to transfer the Service to another person, such request will be evaluated by the Seller and may be approved subject to supplier and operational conditions.

5. RIGHT OF WITHDRAWAL & CANCELLATION POLICY

5.1. General Rules

  • The Buyer may cancel the Service up to 48 hours before the scheduled start time.
  • For cancellations made between 48 and 24 hours before the Service, 50% of the total amount will be refunded.
  • For cancellations made less than 24 hours before the Service, no refund will be issued.
  • For bookings during national holidays and peak seasons, cancellations must be made at least 7 days in advance to receive a 90% refund; 10% is retained as administrative and banking fees.
  • If different conditions are specified on the tour/package page, those special conditions shall prevail.

5.2. Special Cases

  • If the Seller is unable to provide the Service due to force majeure (such as severe weather, technical failure, natural disaster, governmental restrictions, etc.), the full amount paid by the Buyer will be refunded within 5 business days, or, upon the Buyer’s request, kept as an open-date credit/voucher.
  • Cancellation requests must be submitted directly to the Seller by the person who made the booking.

6. RIGHTS & OBLIGATIONS OF THE PARTIES

  • The Buyer is responsible for providing accurate, up-to-date information when making a reservation.
  • The Buyer is solely responsible for all actions carried out through their account and for any communications made on the Website.
  • The Seller may be required to share certain information with competent public authorities in accordance with applicable legislation.
  • The Buyer agrees not to misuse the Services, campaigns or discounts for unfair advantage.

7. INTELLECTUAL PROPERTY RIGHTS

All designs, software, source code, content, visuals, trademarks and domain names on the Website are owned by the Seller or its licensors.

The Buyer may not copy, reproduce, distribute, publish, display, or use any content from the Website for commercial purposes without the prior written consent of the Seller.


8. TERMINATION OF THE AGREEMENT

  • Either Party may terminate this Agreement in accordance with applicable law where a legitimate reason exists.
  • The Seller reserves the right to cancel reservations and/or suspend or terminate the Buyer’s account if the Buyer violates this Agreement, the Website’s terms of use, or any applicable legal regulation.

9. FORCE MAJEURE

Events beyond the Seller’s reasonable control – including but not limited to earthquakes, floods, fires, wars, acts of terrorism, pandemics, transportation disruptions, technical failures, strikes or governmental restrictions – shall be considered force majeure.

In such cases, the Seller shall not be held liable for non-performance or delayed performance, and the terms and conditions imposed by local suppliers and authorities shall apply.


10. DISPUTE RESOLUTION

For consumers resident in Turkey, disputes arising from this Agreement shall fall under the jurisdiction of the Consumer Arbitration Committees and Consumer Courts located at the Buyer’s or Seller’s domicile.

For all other cases, the competent courts and enforcement offices of the relevant jurisdiction shall have authority, and applicable law shall be determined according to the conflict-of-law rules in force.

This Distance Sales Agreement becomes effective upon its publication on the Website and upon the Buyer’s electronic approval.
